Financial Advisor to the Government of the Dominican Republic's mining authorities (Dirección General de Minería and the Unidad Corporativa Minera) to assist with the tender process of Rosario Dominicana's Pueblo Viejo Gold Silver Mine. Assignment also included reform and modernization of the Government's mining law and fiscal regime as it relates to the mining industry. Collaborated with the Central Bank of the Dominican Republic and Rosario Dominicana. Also assisted the mining authorities in the studies for the promotion of mining investments in association with the private sector to comply with Presidential directives.
Consultant to the Pakistan Ministry of Petroleum and Natural Resources (Minerals). Recommended a modern national mineral policy to attract foreign investors to develop the mining sector. Drafted modern mineral concession rules, new mining law, and fiscal regime in addition to preparing informational brochures to promote the mining industry in Pakistan.
Advisor to Government of Kazakhstan. Examined key elements of legal regime governing trade, foreign investment, procurement and competition, to bring in line with international standards. Drafted Concessions Law for legal framework for investment in infrastructure projects. On behalf of a major British bank advising Argentine Government, evaluated reforms to natural resource legislation to improve collateralization/securitization of mineral property rights to facilitate financing of major projects in feasibility/bankability stage. Compared relevant experience and practices in other countries. Nominated as director of fund intended to finance infrastructure projects serving common needs of multiple projects.
Under auspices of the UN, did comprehensive study for Colombian Government of legal regimes of Australia, Botswana, Canada, Indonesia, South Africa, PRC and US, comparing critical aspects of attracting foreign investments in coal mining, concentrating on mining and hydrocarbon codes, taxation, foreign investment, currency controls and regulatory and contracting roles of state agencies. Carried out follow-on mission to Peru to assess potential for coal development, focusing on constraints under existing legal regime and feasibility of promoting small-scale enterprises. As further consequence of the comparative study, served as advisor to Bolivian Government on legal reform to facilitate foreign investment and privatization in mining.
Advisor to the Government of Tajikistan on legal reform, economic transformation and privatization. Identified projects in different sectors, including mining, appropriate for privatization, and areas of legal reform essential to inducing foreign investment and successful privatization. Facilitated contacts with World Bank, IMF and US government agencies, and arranged invitation of US NGO assistance in constitutional and legal reform.
As a company representative to Council of Americas, played significant role in promoting and facilitating negotiations between Argentine and US Governments concerning a bilateral tax treaty, and between the Chilean and US Governments for the establishment of OPIC programs in Chile.
